REPORTING OPTIONS

Reporting a sexual assault to any of the resources listed below does not automatically mean you must go through a criminal and/or disciplinary complaint process. Reporting a sexual assault gives you that option should you, at some point, decide that you wish to pursue a complaint.

FILING A REPORT: WHAT HAPPENS NEXT?

  • You will be treated with care and support.
  • You will be provided with information about available on- and off-campus resources.
  • In general, the University will only pursue a University sexual misconduct investigation if you choose to file a Formal Complaint. In some cases, if an incident suggests an ongoing threat to the community, the University must weigh your choice against the University’s obligation to provide a safe environment for all community members, including you.
  • Timely reporting is of critical importance since proof of criminal offense requires that local police collect and preserve evidence immediately after an assault. Ideally, you should not wash, douche, use the toilet, drink, chew gum, or change your clothing prior to a medical exam.
  • If you decide to seek treatment at a local hospital, be aware that the hospital is obligated to contact the local police. You may choose whether or not to talk with the police.

 

RESOLUTION PROCESS

A formal complaint to the Title IX Coordinator is a written request that the University conduct an investigation into a report of sexual misconduct.

  • Supportive measures are available to impacted parties throughout any next steps and processes.
  • All parties have the right to be free from retaliation.
  • Complainants and Respondents may have an advisor accompany them to any meetings.  
  • Individuals involved in reports and resolution of sexual misconduct have completed extensive training on policy, procedures and the issues of sexual misconduct on college campuses.
  • At any time after the filing of a formal complaint with the Title IX Coordinator, either the Complainant or Respondent may request informal resolution in lieu of formal resolution. (Except in cases where a student alleges that a faculty or staff member engaged in sexual misconduct.)
  • A trained investigator will conduct an investigation.  Investigations normally include interviewing the parties, interviewing witnesses as appropriate, and collecting relevant documentary, electronic, or other evidence.
  • Complainants and Respondents are entitled to same opportunities to:

o   Review and respond to all evidence

o   Review and respond to the Investigative Report

o   Present relevant statements and witnesses at a hearing

o   Have an advisor conduct cross-examination at a hearing

o   Receive written notice of outcome following a hearing

o   Submit an appeal

  • Anyone found responsible for violating the University’s Sexual Misconduct policy, are subject to the full range of sanctions up to and including expulsion or dismissal.

A Complainant who wishes to pursue a criminal complaint is encouraged to make a report to law enforcement.

Incidents occurring on campus are within the jurisdiction of ÄÌÌÇÖ±²¥ University Department of Public Safety. Actions occurring off campus are within the jurisdiction of one of several surrounding townships, most of which are listed above. If the Complainant does not know in which municipality the incident occurred, the Complainant should contact the Sexual Assault Resource Coordinator, Public Safety or 911 for assistance.

Upon request, the Sexual Assault Resource Coordinator on call or a representative of the Department of Public Safety can accompany a Complainant to the police department with jurisdiction and assist a Complainant in making a criminal report.

Notifying municipal law enforcement will generally result in the Complainant, and in some cases the Respondent, being contacted by a municipal police officer. The police will determine if a criminal investigation will occur and if the case will be referred for prosecution.

Unless there are compelling circumstances, the University will typically not file an independent police report without the consent of the Complainant.
